今日の説明は「実録、法に基づかない不法な逮捕・監禁」ＮＯ：009 です。
1． 事件の概要
幇助事件の元である中国人４人の入管法違反（資格外活動）事件
東京都千代田区のＬ社が、２００９年４月度の定期採用として２００８年秋に、２００９年３月卒業予定の中国人４人に採用内定を出し、その際２００９年４月１日付で採用として「雇用契約書」を締結して交付しました。
中国人４人は年末から年始にかけて東京入管に、在留資格を「留学」から「技術」や「人文・国際業務」の在留資格として必要書類を添付して在留資格変更の申請を行ったのです。
入管より、在留資格申請の審査に合格したので、在留資格を付与するとの葉書が届いたので、中国人４人は３月卒業式後、卒業証書を持って東京入管へ行き、葉書と引き換えにパスポートに証印を受けました。
しかし、Ｌ社は２００８年秋に発生したリーマンショックで受注予定の仕事が激減したため卒業予定の中国人を採用しなかったのです。
それで中国人４人は、日本の景気が回復するのを待つため、留学生時代にアルバイトで勤務していた居酒屋などで、それぞれ資格外の不法就労をしていたところを、２０１０年５月に「入管法違反（資格外活動）の罪で警視庁に逮捕されたのです。

1. Outline of case
